Ars Fidelium Academy Enrollment Terms and Conditions

These Enrollment Terms and Conditions (the “Terms”) are a legal agreement between the adult who purchases or uses an Ars Fidelium Academy family membership (“you” or “Parent”) and Ars Fidelium LLC, an Oregon limited liability company (“Ars Fidelium,” “we,” “us,” or “our”). These Terms govern enrollment in and use of the online Ars Fidelium Academy at academy.arsfidelium.com (the “Academy”), including its courses, videos, downloads, parent and student accounts, seasonal materials, and other membership resources (collectively, the “Services”).

By checking the box stating that you agree to these Terms, submitting payment, or using the Services, you confirm that you have read and agree to these Terms. If you do not agree, do not enroll or use the Services.

Important Enrollment Disclosures

Please read these points before enrolling:

1. The Academy is a developing curriculum. The complete planned K–12 sequence is not currently available. Only courses and lessons identified as currently available on the enrollment page or Academy Scope & Sequence are available immediately.
2. Foundations I is released progressively. For the Founding Families Annual Tuition membership, Ars Fidelium will release Foundations I progressively during your initial paid membership year. The remaining planned K–12 sequence is not promised during that year. Section 4 explains the curriculum-development commitment in full.
3. The membership renews automatically. Unless you cancel before the next billing date, the annual membership renews for another one-year term and the payment method on file will be charged the renewal price shown at checkout or otherwise disclosed to you in advance. Section 6 explains renewal and cancellation.
4. Tuition is generally nonrefundable after access begins. Canceling stops future renewal charges but does not ordinarily produce a refund or credit for the current paid term. Section 8 explains the refund policy and its exceptions.
5. The membership is for one family household. It may be used by the enrolling parent or legal guardian and that adult’s children, but it may not be shared with another family, school, parish, co-op, tutoring business, or classroom. Section 5 explains the license.
6. Adult supervision is required. A parent or another responsible adult must determine whether each activity and material is suitable for the child and provide appropriate supervision. Art supplies are purchased separately. Section 12 explains safety responsibilities.

1. Eligibility and Authority

1.1 Adult enrollment

You must be at least 18 years old and legally capable of entering a contract to purchase a membership. A child may not purchase a membership or create a family account.

1.2 Parent or legal guardian

You may create or authorize a student account only for a child for whom you are the parent or legal guardian. By creating a student account, you represent that the information provided is accurate and that you have authority to authorize the child’s participation and the collection and use of the child’s information as described in the Academy Privacy Policy and Children’s Privacy Notice.

1.3 Family use only

The standard family membership is intended for personal, noncommercial educational use within one immediate family. For these Terms, your “family” includes you and the children for whom you are a parent or legal guardian, including children who divide their residence between households. It does not include friends, extended-family households, unrelated students, co-op participants, parish groups, or classroom students.

1.4 Schools, parishes, co-ops, and other organizations

A family membership does not authorize institutional, classroom, group, or commercial use. A school, parish, homeschool co-op, tutorial, studio, teacher, or other organization must obtain a separate written license from Ars Fidelium before using the Services with its students or members.

2. The Academy and Its Educational Purpose

2.1 Nature of the program

Ars Fidelium is an explicitly Catholic art-education program. The curriculum may include Catholic prayers, Scripture, saints, sacred art, traditional iconography, Latin, history, geometry, studio practices, and theological or devotional themes. Curricular selections and explanations reflect Ars Fidelium’s educational mission and judgment.

2.2 No representation of ecclesiastical sponsorship

Unless expressly stated, Ars Fidelium is an independent business and does not claim sponsorship, accreditation, endorsement, or official approval by a diocese, parish, religious order, school, or other ecclesiastical authority.

2.3 Supplemental educational service

The Academy provides educational materials and instruction; it is not a school of record, accredited institution, childcare provider, or substitute for a parent’s educational oversight. Ars Fidelium does not issue diplomas, official transcripts, academic credit, or legal homeschool approval unless a particular offering expressly states otherwise in writing.

You remain responsible for determining how the Services fit your child’s needs and for complying with homeschool, compulsory-attendance, recordkeeping, assessment, or other educational requirements that apply where you live.

2.4 No guaranteed outcome

Student development varies. Ars Fidelium does not guarantee a particular artistic, academic, spiritual, or other result, and completion of a course does not guarantee mastery, credit, admission, certification, or employment.

3. What a Membership Includes

3.1 Included Services

During the active paid term, a family membership provides the enrolling family with access to:

• The courses and lessons identified as included in that membership and currently published in the Academy;
• Additional included courses and lessons that Ars Fidelium releases during the active paid term;
• Parent-managed student accounts and individual lesson-progress tracking;
• Included printable student pages, supply information, and other course resources;
• The Parent Dashboard, progress reports, and account-management features; and
• Any seasonal Extension Packs, galleries, or other resources expressly identified as included with the membership and available during their stated availability periods.

Membership benefits, included course categories, and seasonal availability may vary by membership type. The checkout page and any product-specific terms displayed there are incorporated into these Terms.

3.2 Supplies and equipment not included

Tuition does not include art supplies, tools, printing, internet service, computers, tablets, cameras, or other equipment. Supply links are provided for convenience. Unless expressly stated, Ars Fidelium does not receive compensation from suggested suppliers and does not guarantee a supplier’s price, availability, shipping, product quality, or suitability. Comparable substitutions may be used when they meet the lesson specifications.

3.3 Digital access only

Unless an offering expressly states otherwise, the Services are delivered digitally. You are responsible for a compatible device, a supported current web browser, reliable internet access, the ability to stream video, and the ability to view or print common document formats.

3.4 Content availability by age or level

Course-placement and grade-range information is guidance, not an individualized assessment. Parents may use their judgment when choosing a level, but prerequisites, progression rules, or staged releases may affect access to particular lessons or courses.

4. Curriculum Availability and Ongoing Development

4.1 Developing K–12 sequence

Ars Fidelium is building a planned K–12 curriculum in stages. The complete sequence is not available at the time these Terms are published. The current Academy Scope & Sequence distinguishes content that is Available, In Development, or Planned.

Only content identified as available at the time of enrollment is immediately accessible. A course, project, feature, or resource labeled In Development, Planned, Coming Soon, or similar is not currently available and is not included as an immediate deliverable.

4.2 Foundations I commitment for the initial Founding Families term

For a family purchasing the Founding Families Annual Tuition membership while Foundations I is still in development, Ars Fidelium will release the Foundations I course progressively during the family’s initial one-year paid term.

Ars Fidelium may revise the sequence, combine or divide lessons, substitute projects, replace examples, change materials, or otherwise refine Foundations I as pedagogically appropriate. These changes do not breach this commitment so long as Ars Fidelium delivers the completed Foundations I course in substantially the educational scope represented in the Scope & Sequence.

If Foundations I is not complete by the end of that initial paid term, the family will receive continued access, without additional tuition, to Foundations I and the account functions reasonably necessary to use it until the course is complete. This limited continuation does not include access to other courses, newly released membership benefits, or seasonal resources after the paid term unless the family renews. It is the family’s remedy for a delay in completing Foundations I, except where applicable law requires another remedy.

4.3 No promise to complete the entire K–12 sequence during one term

Enrollment does not guarantee that the full planned K–12 sequence, or any course other than the commitment expressly stated in Section 4.2 or on the applicable checkout page, will be completed or released during your membership term. Ars Fidelium does not promise a particular release date for content identified as In Development or Planned.

4.4 Release pace and student pacing

New lessons may be published progressively rather than as a complete course at the beginning of the term. A student who works more quickly than the suggested pace may reach the end of currently released content and need to wait for later lessons. The number and timing of releases may vary due to production, review, illness, technical problems, or other circumstances.

4.5 Curriculum changes

Ars Fidelium may correct errors and revise, replace, reorder, add, or remove lessons, projects, prayers, examples, resources, techniques, supply recommendations, or course structures. We will not use this right to eliminate a material paid benefit without a reasonable substitute, extension, credit, or other remedy appropriate to the circumstances.

5. Household License and Intellectual Property

5.1 Limited license

Subject to these Terms and payment of tuition, Ars Fidelium grants you a limited, revocable, nonexclusive, nontransferable license during the active access period to use the Services for the personal, noncommercial education of your family.

5.2 Permitted family copying

You may download included files when a download is provided and print a reasonable number of copies for the participating children in your family. You may retain completed student pages and portfolio materials for your family’s personal educational records after access ends.

5.3 Prohibited use

Without prior written permission from Ars Fidelium, you may not:

• Share a parent or student login with another household or unauthorized person;
• Enroll or teach children outside your family through a family membership;
• Copy, reproduce, republish, upload, distribute, sell, sublicense, lend, or give Academy materials to another person or organization;
• Post lesson videos, substantial lesson text, worksheets, teacher demonstrations, downloads, or answer materials publicly or in a private group;
• Record, rebroadcast, livestream, screen-capture, or make substitute recordings of instructional videos, except for a brief capture reasonably necessary to obtain technical support;
• Remove copyright, trademark, attribution, access-control, or other proprietary notices;
• Scrape, crawl, systematically download, index, data-mine, reverse engineer, or use automated means to access or extract the Services;
• Use Academy content to train or evaluate an artificial-intelligence or machine-learning system;
• Create, market, or distribute a competing or derivative curriculum based substantially on the Services; or
• Circumvent course progression, account limits, security measures, payment controls, or access restrictions.

5.4 Student artwork

The student owns the original artwork the student creates. Ars Fidelium does not acquire ownership of student work merely because the student follows an Academy lesson.

If you voluntarily send a photograph of student work to Ars Fidelium for support or feedback, you give Ars Fidelium a limited permission to view, copy, and internally use it only as reasonably necessary to respond. Ars Fidelium will not use a child’s name, image, or artwork for public marketing without separate permission from the parent or legal guardian.

5.5 Ownership of the Services

The Services, including original videos, recordings, demonstrations, lesson text, designs, diagrams, worksheets, project examples, compilations, page layouts, logos, names, and branding, are owned by or licensed to Ars Fidelium and are protected by intellectual-property laws. Public-domain artworks or third-party materials remain subject to their respective legal status and ownership. No ownership right is transferred to you.

“Ars Fidelium,” “Ars Fidelium Academy,” associated logos, and related branding may not be used in a way that suggests sponsorship, affiliation, or endorsement without written permission.

6. Term, Automatic Renewal, and Founding Families Pricing

6.1 Initial term

The current annual family membership begins when the first payment is successfully processed and continues for one year, unless the checkout page identifies a different start date or term. The exact paid-through date appears in your Academy account.

6.2 Automatic renewal authorization

Your annual membership renews automatically for successive one-year terms until you cancel. By affirmatively accepting these Terms and submitting payment, you authorize Ars Fidelium and its payment processor to charge the payment method on file on each renewal date for the renewal price and any applicable taxes disclosed to you.

There is no minimum purchase obligation beyond the initial paid one-year term. You may prevent the next renewal by canceling before the next billing date.

6.3 Renewal price

The renewal price is the price displayed at checkout or otherwise clearly disclosed to you before purchase, subject to any rate-lock promise that applies to your membership. If Ars Fidelium will change a renewal price or another material renewal term, we will provide advance notice and cancellation information as required by applicable law before the change takes effect.

6.4 Founding Families rate lock

For the Founding Families Annual Tuition membership, the annual tuition is $295 per year and remains $295 for successive annual renewals while that subscription remains continuously active and in good standing.

If the membership is canceled, expires, is refunded, is terminated for breach, or otherwise ceases to be continuously active, the Founding Families rate is forfeited. If the family later returns, enrollment will be subject to the price and membership options then available. Ars Fidelium may correct an obvious billing error, apply a tax required by law, or modify the rate-lock provision when legally necessary, but will provide advance notice of any material change and an opportunity to cancel.

6.5 Renewal acknowledgment and account email

You must maintain an accurate email address in your parent account. Receipts, renewal information, material-change notices, and cancellation information may be sent electronically to that address. We will provide any renewal reminder required by applicable law.

7. Cancellation

7.1 How to cancel automatic renewal

You may cancel automatic renewal at any time before the next billing date by using the cancellation control under My Account → Subscriptions in the Academy. A cancellation submitted through the account control takes effect when submitted. If you cannot access the account control, email info@arsfidelium.com from the email address associated with the parent account and use the subject line Cancellation Request.

An emailed cancellation request is effective when received. If Ars Fidelium receives the request before the renewal charge but a processing delay results in that renewal being charged, Ars Fidelium will reverse or refund the renewal after verifying the timely request. Ars Fidelium will not require a telephone call to cancel an online membership.

7.2 Effect of cancellation

Canceling stops future automatic renewal charges. It does not ordinarily end access immediately. Your family may continue using the included Services through the end of the current paid term, after which paid access ends, subject to the limited Foundations I continuation in Section 4.2 and any short technical grace period displayed in the Academy.

Canceling does not erase student progress immediately. Account and progress information is retained and deleted according to the Academy Privacy Policy and Children’s Privacy Notice.

7.3 Cancellation confirmation

After canceling, retain the cancellation confirmation and verify that the subscription status in your account reflects the cancellation. Contact us promptly if you do not receive confirmation or believe the account status is incorrect.

8. Payments, Failed Payments, Refunds, and Taxes

8.1 Payment processing

Payments are processed through Stripe or another payment processor identified at checkout. You authorize the processor to store and use the payment method as necessary for the initial transaction and authorized renewals. Ars Fidelium does not receive or store your complete payment-card number or card security code.

8.2 Accurate billing information

You agree to provide accurate billing and contact information and to keep it current. You are responsible for charges authorized through your account, except unauthorized charges for which applicable law gives you a remedy.

8.3 Failed or disputed payments

If a payment fails, is reversed, or remains unpaid, Ars Fidelium may notify you and temporarily continue access during a grace period. If payment is not resolved, we may suspend or end access. A current Academy configuration may provide a seven-day technical grace period after the paid-through date, but a grace period is not an extension of the membership term or a waiver of payment.

If you believe a charge is incorrect, contact info@arsfidelium.com promptly so we can investigate. Nothing in these Terms limits any nonwaivable right to dispute an unauthorized or erroneous charge with your financial institution.

8.4 Refund policy

Except as required by applicable law or expressly stated below, tuition and renewal payments are nonrefundable after Academy access begins. Canceling does not create a prorated refund, credit, or reimbursement for unused time, student inactivity, scheduling changes, dissatisfaction, failure to purchase supplies, or failure to use the Services.

Ars Fidelium will review a written refund request in good faith when it concerns:

• A duplicate or demonstrably erroneous charge;
• A verified technical incompatibility or persistent defect that prevents the family from making reasonable use of the core Services and that Ars Fidelium cannot resolve after a reasonable opportunity to provide support;
• A failure by Ars Fidelium to provide a material paid benefit without the extension, substitute, credit, or other remedy promised in these Terms; or
• Exceptional circumstances that Ars Fidelium determines warrant a full or partial refund.

Send the request to info@arsfidelium.com with the subject line Refund Request, preferably within 30 days after the charge or the problem giving rise to the request. Include the parent-account email address, transaction date, and a brief explanation, but do not send complete card information.

Refunds outside rights required by law are evaluated case by case and do not establish a general right or precedent. If a full refund is issued, Academy access associated with that payment may end when the refund is processed. If Ars Fidelium permanently discontinues the paid Services before the end of a term for reasons unrelated to your breach, Ars Fidelium will provide an appropriate substitute, continued limited access, or a prorated refund for the materially unavailable portion of the term.

8.5 Taxes and currency

Prices are stated in the currency shown at checkout. You are responsible for applicable taxes, currency-conversion charges, or payment-provider fees disclosed in connection with the transaction. Ars Fidelium will collect taxes when legally required.

8.6 Discounts and coupons

Coupons and discounts apply only according to their stated terms, have no cash value, and may not be combined unless expressly allowed. An introductory or promotional price does not continue at renewal unless the checkout page expressly states that it is locked or recurring.

9. Parent and Student Accounts

9.1 Separate accounts

The purchasing adult receives a parent account. Each participating child must use a separate student account created and controlled by the parent so that enrollment and progress can be recorded individually. Students may not create their own accounts.

9.2 Account information

You agree to provide accurate parent and student information, use only the minimum student information requested, and update information when reasonably necessary. Do not use a student’s full last name, personal email address, or other unnecessary identifying information in a username.

9.3 Credential security

You are responsible for maintaining the confidentiality of parent and student credentials and for activity under the family’s accounts. Use unique passwords, do not reuse passwords from other services, and do not allow another household to use the accounts. Notify info@arsfidelium.com promptly if you suspect unauthorized access.

9.4 Parent supervision of online use

The parent is responsible for deciding when and how each child uses the Academy and for supervising the child’s account and internet access. The Academy does not provide chat, public student profiles, student-to-student messaging, or direct email to managed student accounts.

9.5 Progress records

Lesson completion and progress indicators are organizational tools. They may be affected by user actions, browser behavior, software changes, or technical errors and are not official academic records. Parents should retain any independent records required for their homeschool or other educational program.

10. Acceptable Use and Conduct

You and participating students must use the Services lawfully, respectfully, and in accordance with these Terms. You may not:

• Attempt to gain unauthorized access to another account, restricted content, the Academy’s systems, or administrative functions;
• Introduce malware, harmful code, excessive automated traffic, or other material that disrupts or threatens the Academy;
• Use the Services to harass, threaten, impersonate, defraud, or violate another person’s rights;
• Submit false enrollment, billing, consent, or support information;
• Use the Services or content for unlawful, exploitative, obscene, or abusive purposes; or
• Encourage or assist another person in violating these Terms.

Ars Fidelium may investigate suspected misuse and may restrict or suspend access while addressing a security threat, unauthorized sharing, fraud, or a material violation.

11. Privacy and Children’s Information

11.1 Privacy Policy

The Ars Fidelium Academy Privacy Policy and Children’s Privacy Notice is incorporated into these Terms and explains the information collected, how it is used and disclosed, how long it is retained, and the rights available to parents and users.

11.2 Parental authorization

Before creating student accounts, you must separately confirm that you are each listed student’s parent or legal guardian, acknowledge the Privacy Policy and Children’s Privacy Notice, and authorize creation and operation of the accounts. Acceptance of these Terms does not replace any separate parental authorization required during student setup.

11.3 Withdrawal and deletion

A verified parent may request access to, correction of, or deletion of a child’s information or withdraw permission for further collection or use as described in the Privacy Policy. If information necessary to operate a student account is deleted or consent is withdrawn, that student’s access will end. Ending a student account does not by itself cancel the paid parent subscription or create a refund.

12. Art Materials, Safety, and Adult Supervision

12.1 Parent responsibility

Art activities may involve materials or tools that can stain, irritate, cut, puncture, spill, create dust or fumes, cause allergic reactions, or present choking or other hazards if misused. The parent or supervising adult is responsible for:

• Reviewing each lesson and its supplies before the child begins;
• Determining whether the activity, tool, and material are appropriate for the child’s age, abilities, health, and circumstances;
• Reading and following product labels, safety instructions, age ratings, and manufacturer guidance;
• Providing close adult supervision and assistance as appropriate;
• Choosing a safe, ventilated, protected workspace;
• Providing protective clothing, eye protection, ventilation, or other safeguards when appropriate;
• Managing allergies, sensitivities, accessibility needs, and safe storage and disposal; and
• Substituting or omitting a material or activity when safety requires.

12.2 Lesson guidance is not a substitute for product instructions

Any safety reminder in a lesson is general educational guidance and does not replace a product label, safety data sheet, manufacturer instruction, professional advice, or the supervising adult’s judgment. If lesson guidance conflicts with a product’s instructions, follow the product’s instructions and do not use the material unless it can be used safely.

12.3 Medical or emergency matters

Ars Fidelium does not provide medical advice. In an emergency, stop the activity and contact the appropriate emergency service or poison-control resource for your location. For health conditions, allergies, or other individual concerns, consult a qualified professional before participating.

13. Third-Party Services and Links

The Academy depends on third-party services such as website hosting, payment processing, video delivery, email delivery, and software providers. It may also link to suppliers, museums, archives, public-domain collections, or other external websites.

Third parties may have their own terms and privacy practices. Ars Fidelium is not responsible for the independent content, availability, security, pricing, products, or practices of a third-party website or service. A link does not necessarily constitute endorsement. This Section does not limit Ars Fidelium’s responsibility for choosing and managing service providers as required by applicable privacy or consumer law.

14. Service Availability, Maintenance, and Changes

14.1 Reasonable availability

Ars Fidelium will use reasonable efforts to keep the Academy available, but uninterrupted or error-free access is not guaranteed. Access may be affected by maintenance, updates, internet or hosting failures, video-platform problems, cyber incidents, payment-system issues, force majeure events, or other circumstances.

14.2 Maintenance and corrections

Ars Fidelium may temporarily restrict access to maintain security, correct errors, update software, improve the Services, or protect users and systems. We will use reasonable efforts to address material outages and communicate significant extended interruptions.

14.3 Features and providers

Ars Fidelium may modify features, navigation, software, service providers, or delivery methods. We will not intentionally remove a material paid benefit without a reasonable substitute or remedy and will comply with notice and consent requirements that apply to material changes.

15. Suspension and Termination

15.1 Suspension or termination for breach

Ars Fidelium may suspend or terminate some or all access if you materially violate these Terms, fail to pay amounts due, share access outside the family, infringe intellectual-property rights, misuse the Academy, compromise security, or provide false consent or enrollment information.

When reasonably appropriate, Ars Fidelium will provide notice and an opportunity to correct the violation. We may act immediately when necessary to protect a child, another person, the Academy, intellectual property, payment integrity, or system security.

15.2 Effect of termination for breach

If access is terminated for your material breach, you remain responsible for charges already incurred and are not entitled to a refund except where required by law. The license in Section 5 ends immediately, apart from the right to retain completed family portfolio materials as stated there.

15.3 Termination by Ars Fidelium without breach

If Ars Fidelium ends a paid membership before its expiration for a reason unrelated to your breach, we will provide an appropriate substitute, continued limited access, or a prorated refund for the materially unused part of the term.

15.4 Provisions that survive

Sections concerning intellectual property, payment obligations, disclaimers, limitations of liability, disputes, governing law, and any other provision that by its nature should continue will survive expiration or termination.

16. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Ars Fidelium disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement to the extent those warranties may lawfully be disclaimed.

Ars Fidelium does not warrant that every device, browser, printer, internet connection, third-party service, supply substitute, or individual learning need will be compatible with the Services; that the Academy will be uninterrupted or error-free; or that every error can be corrected immediately.

These disclaimers do not exclude an express commitment in these Terms and do not limit a warranty, remedy, or consumer right that applicable law does not permit the parties to waive.

17. Limitation of Liability

To the fullest extent permitted by law:

1. Ars Fidelium will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of data, opportunity, profit, or goodwill, arising from or related to the Services, even if advised that such damage was possible.
2. Ars Fidelium’s total aggregate liability arising from or related to a membership or the Services will not exceed the tuition you paid to Ars Fidelium for that membership during the 12 months immediately preceding the event giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, gross negligence, liability for death or personal injury to the extent caused by negligence and not lawfully excludable, violation of children’s privacy rights, infringement caused by Ars Fidelium, obligations to pay an expressly promised refund, or any other liability or remedy that applicable law does not permit the parties to limit.

Some jurisdictions do not allow particular warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the extent permitted by law.

18. Events Beyond Reasonable Control

Ars Fidelium is not responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, fire, severe weather, epidemic, war, civil disorder, labor disruption, utility or internet failure, cyberattack, government action, serious illness or incapacity, or failure of a critical third-party provider.

This Section does not excuse payment obligations already due or eliminate the curriculum-continuation, substitute, credit, or refund remedies expressly stated in these Terms. Ars Fidelium will use reasonable efforts to reduce the effect of the event and resume performance.

19. Changes to These Terms

Ars Fidelium may update these Terms to reflect changes in the Services, law, security needs, or business practices. The revised version will be posted with a new “Last updated” date.

A change will not retroactively reduce a material benefit already purchased during a current paid term unless the change is required by law, needed for safety or security, or accompanied by a reasonable substitute or remedy. For a material change affecting automatic renewal, price, cancellation, curriculum commitments, household rights, or another significant obligation, Ars Fidelium will provide clear advance notice to the parent-account email address and cancellation information before the change applies, and will obtain new consent when required by law.

Continued use after a nonmaterial update takes effect constitutes acceptance of the updated Terms. If you do not agree to a material change, you may cancel renewal; your rights for the remainder of the already-paid term will be governed by the version that applied when that term began, except where law requires otherwise.

20. Electronic Communications and Records

You consent to receive contracts, notices, receipts, invoices, cancellation confirmations, and other records electronically at the email address associated with your account or through the Academy. You may retain these records by saving or printing them.

You are responsible for keeping your email address current and checking messages from Ars Fidelium. Electronic acceptance of these Terms has the same effect as a handwritten signature to the extent permitted by law.

21. Dispute Resolution and Governing Law

21.1 Contact us first

Before filing a legal claim, you and Ars Fidelium agree to make a good-faith effort to resolve the dispute informally. Send a written description of the problem and requested resolution to info@arsfidelium.com with the subject line Legal Notice and, when available, by mail to the address in Section 24. Ars Fidelium will make a good-faith effort to respond within 30 days.

This informal process does not prevent either party from seeking urgent injunctive relief, filing an eligible small-claims matter, meeting a legal deadline, reporting a matter to a regulator, or exercising a right that cannot lawfully be restricted.

21.2 Oregon law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. Any court proceeding arising from these Terms will be brought in a state or federal court with jurisdiction in Marion County, Oregon, and the parties consent to that venue.

This choice of law and venue does not deprive a consumer of a mandatory protection, remedy, or right to bring a claim in another forum that the law of the consumer’s residence does not permit the parties to waive.

21.3 No mandatory arbitration provision

These Terms do not require private arbitration and do not waive a party’s right to a jury trial or participation in a class proceeding where otherwise available under applicable law.

22. International and Other Mandatory Consumer Rights

The Academy is operated from Oregon, United States, but may be purchased by families elsewhere. Accessing the Academy from another jurisdiction does not represent that every feature or offering is lawful or appropriate there.

Nothing in these Terms excludes, restricts, or waives a consumer guarantee, cooling-off right, refund right, privacy right, or other protection that applicable law does not allow the parties to waive. If a provision conflicts with a mandatory law that applies to you, the mandatory law controls only to the extent of the conflict, and the remaining Terms continue to apply.

23. General Legal Terms

23.1 Entire agreement and order of precedence

These Terms, the Academy Privacy Policy and Children’s Privacy Notice, the checkout disclosures, and any product-specific written terms constitute the agreement concerning the membership. If there is a direct conflict, a product-specific term clearly presented and accepted at checkout controls for that product, followed by these Terms, except that the Privacy Policy controls the handling of personal information.

Marketing statements, social-media posts, informal messages, projected timelines, or oral statements do not modify this agreement unless Ars Fidelium expressly incorporates them into the checkout offer or confirms the change in writing.

23.2 Severability

If a court finds a provision unenforceable, it will be enforced to the greatest extent permitted or, if necessary, severed, and the remaining provisions will remain in effect.

23.3 No waiver

A failure or delay in enforcing a provision does not waive the right to enforce it later. A waiver must be in writing and applies only to the specific circumstance stated.

23.4 Assignment

You may not transfer the membership or assign these Terms without Ars Fidelium’s written consent. Ars Fidelium may assign these Terms in connection with a merger, reorganization, financing, or sale of the business or substantially all relevant assets, provided the successor assumes the material obligations owed to current members and handles personal information as required by law.

23.5 No third-party beneficiaries

Except as expressly stated, these Terms do not create rights for a person or entity that is not a party to them.

23.6 Headings

Headings are for convenience and do not limit the meaning of a provision.
